Summary

JaguareBay logo Land RovereBay logo North America, LLC (Land RovereBay logo) is recalling certain 2016-2017 Range Rover and Range Rover Sport vehicles. The driver’s seat belt Emergency Locking Retractor (ELR) may not lock as designed. As such, these vehicles fail to comply with the requirements of the Federal Motor Vehicle Safety Standard (FMVSS) number 209, “Seat Belt Assemblies.”

 

Remedy

Land RovereBay logo will notify owners, and dealers will inspect the seat belt assembly, replacing it if necessary, free of charge. The recall began September 10, 2019. Owners may contact Land RovereBay logo customer service at 1-800-637-6837. Land RovereBay logo’s number for this recall is N333.

JaguareBay logo Land RovereBay logo North America, LLC has informed the National Highway Traffic Safety Administration (NHTSA) of its intent to perform a Non-Compliance Recall on certain 2016-2017 model year Land RovereBay logo Range Rover Sport and Range Rover vehicles imported into the United States market. Information relating to this Recall will be posted on the National Highway Traffic Safety Administration website.

United States Federal regulations require that retailers must be notified within a reasonable time after the manufacturer decides that a defect that relates to motor vehicle safety or a non-compliance exists.

United States Federal law requires retailers to complete any outstanding Recall service before a new vehicle is delivered to the buyer or lessee. Violation of this requirement by a retailer could result in a civil penalty of up to $21,780.00 per vehicle.

This Aftersales Bulletin serves as notification to all Land RovereBay logo retailers in the United States and Federalized Territories that any affected new vehicles may not be sold and delivered for customer use until the Recall repair is completed.

 

DESCRIPTION OF ISSUE

An issue has been identified on a limited number of Land RovereBay logo vehicles within the listed Affected Vehicle Range where the Emergency Locking Retractor (ELR) in the seat belt assembly of the vehicle’s driver’s seat is not to specification. Due to a supplier manufacturing issue, the car-sensitive sensor mechanism does not lock as designed when subjected to the requirements in Federal Motor Vehicle Safety Standards (FMVSS) 209 Section S4.3 (j) (2). This also constitutes a non-compliance with FMVSS 208 S7.1.1.3. The ELR is equipped with a vehicle-sensitive locking mechanism and a webbing-sensitive locking mechanism. The non-compliance specifically involves the vehicle-sensitive mechanism.

EFFECT ON VEHICLE OPERATION

In the event of a pre-crash brake event prior to a crash, the ELR would not lock off at the correct design specification g-force level. This could impact the operation of the seat belt assembly and negatively affect vehicle safety.

 

SERVICE PROGRAM / REWORK ACTION

Owners will be notified by mail and instructed to take their vehicle to an authorized retailer who will replace the front left (driver’s) seat belt assembly. There will be no charge to owners for this action under this program.

 

OWNER NOTIFICATION

Owner notification is expected to occur on or before July 1, 2019.

 

ACTION TO BE TAKEN

Check DDW to ensure that the vehicle is affected by this Program prior to undertaking any rework action.

Retailers are required to HOLD affected new vehicles that are within your control and refrain from releasing the vehicles for new vehicle sale pending completion of the rework action. Affected vehicles already in the hands of customers should be updated at the next available opportunity.

Retailers who choose to proceed against this recommendation, where legally permitted, must clearly and conspicuously disclose the open recall to the applicable customers.

573.6 (c) (7) – Test results and other information that the manufacturer considered in determining the existence of the noncompliance

Autoliv notified on JaguareBay logo Land RovereBay logo November 2, 2016 advising that another customer of theirs submitted a 49 CFR 573 Report to NHTSA which stated that the ELR in the driver’s safety belt assembly may not have been produced to specification. They advised that the component concerned was also supplied to JaguareBay logo Land RovereBay logo. Autoliv advised that a seat belt retractor car-sensitive sensor (CS Sensor) concern could impair proper triggering of the Emergency Locking Retractor (ELR)’s vehicle sensitive mechanism.

JaguareBay logo Land RovereBay logo opened a Product Safety and Compliance Committee (PSCC) investigation that was reviewed at the PSCC meeting on November 15, 2016.

Autoliv informed JaguareBay logo Land RovereBay logo that the other OEM (BMW) had submitted on October 13, 2016, a 49 CFR 573 Report which stated that the Emergency Locking Retractor (ELR) in the driver’s safety belt assembly may not have been produced to specification. Autoliv had identified through testing and analysis to support this submission that JaguareBay logo Land RovereBay logo components may be affected.

The Autoliv investigation identified that during initial analysis of the returned part a potential concern with a subcomponent part of the seatbelt retractor commonly known as the carsensitive sensor (“CS Sensor”).  As a result, Autoliv and BMW commenced further analysis activities to assess and understand the nature of the reported issue.

The CS Sensor is manufactured and supplied by an Autoliv sub supplier and is assembled into the seatbelt retractor.  Focused analysis on the CS Sensor indicated that a deviation in the injection molding manufacturing process at the sub supplier may have occurred which could impair proper triggering of the Emergency Locking Retractor (ELR)’s vehicle sensitive mechanism.  The investigation into this possible manufacturer deviation that could result in the CS Sensor lever and housing to be out of tolerance and cause an interference.

JaguareBay logo Land RovereBay logo supplied eight parts to Autoliv for testing and analysis and on November 25, 2016, Autoliv issued a test report to JaguareBay logo Land RovereBay logo which reflected that 1 out of the 8 parts tested exhibited noncompliance to FMVSS 209 S4.3(j)(2).

Additionally, Autoliv performed a high level technical review/comparison of the BMW parts to the JaguareBay logo Land RovereBay logo parts.  Autoliv has determined that the parts supplied to JaguareBay logo Land RovereBay logo contain the same combination of components which appear to be the major influencing parts on the condition seen in the BMW parts.

This issue was reviewed at JaguareBay logo Land RovereBay logo’s Recall Determination Committee (RDC) on December 1, 2016 where it was acknowledged that this matter is a non-compliance to the requirements of FMVSS 209 but inconsequential to vehicle safety such that a Petition for Decision of Inconsequential Noncompliance in accordance with the provisions of Part 556 be filed. The RDC agreed that the performance requirements of FMVSS 208 were met.

On May 2, 2019 JaguareBay logo Land RovereBay logo North America, LLC received NHTSA’s response to the petition submitted on December 23, 2016.   In this response, NHTSA denied the petition for inconsequential non-compliance and requested JaguareBay logo Land RovereBay logo conduct a recall.

There have been no reported accidents, injuries or fires as a result of this concern.

The Emergency Locking Retractor (ELR) in the seatbelt assembly of the front left seat that is not to specification does not meet the pre-crash braking webbing payout requirements.

The NHTSA has determined that certain seatbelt assemblies do not fully comply with FMVSS 209

Section S4.3 (j) (2). FMVSS 209 is a component-level regulation. FMVSS 208 requires, as stated in S7.1.1.3, a Seatbelt Assembly which meets the requirements of FMVSS 209. As the NHTSA has determined that the component does not comply with FMVSS 209, this also constitutes a noncompliance with FMVSS 208 Section S7.1.1.3.

There is no suggestion that the performance requirements of FMVSS 208 have not been met.

CONDITION SUMMARY:

SITUATION:

A potential issue has been identified on certain Land RovereBay logo vehicles within the listed Affected Vehicle Range where the emergency locking retractor in the seatbelt assembly of the front left seat is not to specification and the vehicle-sensitive sensor mechanism does not lock as designed.

In the event of a pre-crash brake event prior to a crash, the emergency locking retractor would not lock off at the correct design specification g-force level. This could impact the operation of the seatbelt assembly and negatively affect vehicle safety.

ACTION:

Retailers are required to HOLD affected new vehicles that are within your control and refrain from releasing the vehicles for new vehicle sale pending completion of the procedure(s) detailed in this Technical Bulletin. Unsold vehicles should have this performed as part of the Pre-Delivery Inspection (PDI) process but must have it completed prior to vehicle handover to the customer.

If any affected vehicle is also open in Safety Recall P095 – Autoliv Front Seatbelt Pre-Tensioner Operation, complete the inspection procedures detailed in both the N333 and P095 bulletins. if the result of either inspection requires the replacement of the front left seatbelt, complete that under the relevant recall and then submit an inspection only claim for the second recall.

Affected vehicles already in the hands of customers should be updated at the next available opportunity.

42% of affected vehicles are expected to require a new front left seatbelt retractor.

Use the Vehicle Identification Number (VIN) and the Electronic Parts Catalog (EPC) to confirm part number(s) necessary to perform repairs.

Warranty claims must be submitted quoting the Program Code and the relevant Option Code; this will result in payment of the stated time. The SRO and parts information is included for information only. The Option Code(s) that allows for the drive in/drive out allowance may only be claimed if the vehicle is brought back into the workshop for this action alone to be undertaken.

Locate the label on the front left seatbelt.

Vehicles with ebony seatbelts only: inspect both sides of the front left seatbelt label for the production date and part number.

  • If the front left seatbelt part number is ‘CPLA 611B09 ED8PVJ’ and the production date is from 07/05/2016 up to and including 15/09/2016, go to step 5.
  • If the front left seatbelt part number is ‘CPLA 611B09 ED8PVJ’ but the production date is not from 07/05/2016 up to and including 15/09/2016, release the vehicle.

  • If the front left seatbelt part number is ‘CPLA 611B09 ED8AAM’ but the production date is not from 07/05/2016 up to and including 13/09/2016, release the vehicle.
